Terms of Service

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. The Services are intended for business and professional use; you may not use them for personal, non-business purposes.

2. The Services

Post2Viral provides social media management tools, including content scheduling, multi-channel publishing, AI-assisted authoring, comment and reply management, audience analytics, and team collaboration across supported third-party platforms (including Facebook, Instagram, Threads, Twitter (X), LinkedIn, TikTok, YouTube, Pinterest, Reddit, and Bluesky — collectively, the “Social Networks”).

We may add, modify, or remove features at any time. We will provide reasonable notice of material changes that adversely affect paid users.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account. Notify us immediately at info@post2viral.com if you suspect unauthorized access. You are responsible for ensuring that all team members using your account comply with these Terms.

4. Connecting Social Networks

When you connect a Social Network account to the Services, you authorize Post2Viral to access, store, and process data from that Social Network on your behalf, strictly to provide the Services. Your use of each Social Network through Post2Viral is also governed by that Social Network's own terms and policies. You are solely responsible for complying with those terms and for any content you publish.

You may revoke Post2Viral's access to any connected Social Network at any time through the in-app channels settings, by emailing info@post2viral.com, or directly through the Social Network's connected-apps interface.

5. Acceptable Use

You agree NOT to use the Services to:

• Violate any applicable law or regulation, or any Social Network's terms or platform policy.
• Publish content that is unlawful, harassing, defamatory, hateful, sexually explicit, fraudulent, or that infringes third-party intellectual-property or privacy rights.
• Send spam, run unsolicited automated messaging campaigns, or artificially inflate engagement metrics.
• Reverse-engineer, scrape, decompile, or attempt to circumvent technical limits of the Services.
• Upload malware or content that interferes with the Services' security or availability.
• Resell, sublicense, or wrap the Services without our prior written agreement.

We may suspend or terminate your account, with or without notice, for any violation.

6. Your Content

You retain all rights to the content you upload to or publish through the Services (“Your Content”). You grant Post2Viral a limited, worldwide, royalty-free license to host, store, transmit, format, display, and route Your Content solely as necessary to provide the Services to you (for example, to schedule and publish a post on your behalf to a connected Social Network).

You represent and warrant that you have all necessary rights to Your Content and that publishing it through the Services will not violate any law, contract, or third-party right.

7. AI Features

The Services include AI-assisted features (drafting captions, suggesting replies, generating content). AI output is probabilistic and may be inaccurate, biased, or otherwise unsuitable. You are responsible for reviewing and approving any AI-generated content before it is published. Do not rely on AI output for legal, medical, financial, or other professional decisions.

8. Fees and Subscriptions

Some Services are offered free of charge; others require a paid subscription. Subscription fees are billed in advance and are non-refundable except where required by law. Subscriptions auto-renew at the then-current price unless cancelled before the renewal date. We may change pricing with at least 30 days' advance notice.

9. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your account at our discretion if you violate these Terms or if your activity poses a risk to the Services, to other users, or to a Social Network. Upon termination, your right to use the Services ends immediately. Sections 5–13 survive termination.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. POST2VIRAL DOES NOT WARRANT THE BEHAVIOUR, AVAILABILITY, OR POLICIES OF ANY THIRD-PARTY SOCIAL NETWORK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POST2VIRAL'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO POST2VIRAL IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100. IN NO EVENT SHALL POST2VIRAL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL.

12. Indemnification

You will defend, indemnify, and hold harmless Post2Viral and its officers, directors, employees, and agents from any third-party claim arising out of (a) Your Content, (b) your use of the Services, or (c) your violation of these Terms or any law or third-party right.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to that jurisdiction. Nothing here prevents either party from seeking injunctive relief in any court of competent jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or by a prominent notice on the Services at least 30 days before the change takes effect. Continued use of the Services after a change becomes effective constitutes acceptance of the updated Terms.
